CONTRACT between

Alpha School of English of Arznell Street, St. Paul's Bay, Malta, represented on this Agreement by Ms Patricia Marshall B.A. (Hons.) P.G.C.E., Managing Director of the School, of the first part;

And of the second part

(Agency Name), represented on this Agreement by (Agency Person, Agency Address)

The parties agree as hereunder:

(1) Alpha School of English agrees to accept, subject to availability of space, groups and/or individual students sent to it by (Agency Name) or English Language Courses and/or vacations run and organised by it;

(2) The commission for agents is for the tuition component of the courses only; 20% for individual students, 25% on groups of 5 to 20 students and 35% on groups of 21+ students. Terms and conditions are according to the Alpha School of English's brochures and price-lists currently in force. Should there be any change in the terms and conditions, Alpha School of English will immediately inform (Agency Name).

(3)  (Agency Name) will pay a deposit of 10% of the total cost of any booking made in order to secure the reservation, and will give as much notice as possible in order to facilitate the issue of the necessary visas by the competent authorities.

(4) All fees and expenses must be paid in full at least two weeks prior to the commencement of courses/vacations.

(5) Payment is to be made by bank transfer to the following bank account:

(6) Should any booking be cancelled more than one week before arrival in Malta, no cancellation fee will be charged. Should a booking be cancelled less than one week before arrival in Malta, a cancellation fee of 50% will be charged by the School. No refunds will be given after the English course / vacation has commenced. Similarly, no refunds will be given for classes not attended or for ‘no-shows’.

(7) The School is closed at weekends and on public holidays. Lessons take place at the school between Monday and Friday, between 09.00h and 16.30h. At the discretion of the Principal, lessons may take place outside these hours, and outside school premises. The following days are public holidays in Malta: January 1, February 10, March 19, 31, Good Friday, May 1, June 7, 29, August 15, September 8, 21, December 8, 13, 25.

(8) When there is only one student taking a group course, the number of lessons is reduced by one third.

(9) The School is not liable for theft or loss of students' possessions. Nor is it liable for any accident that may occur on or off the school premises. We strongly recommend that all students traveling to Malta take out Health & Travel Insurance.

(10) Any student who behaves disreputably and fails to abide by the laws of the school and/or the laws of Malta could be sent home without warning depending on the gravity of the offence. No refund will be given.

(11) If any student booked through (Agency Name) purchases directly or indirectly any English Course or Sports Course through Alpha School of English, the school will inform the agent of the purchase within four weeks. The school will send the agreed commission to the agent according to the agent’s instructions.  The commission must be received by the agent within four weeks of students’ departure. All bank charges are at agent’s expense.

(12) Should a unique situation arise wherein Alpha School of English is unable to provide a student with part or all of their course, they will be refunded for all lessons missed.

(13) All binding communication between (Agency Name) and Alpha School of English must be in written form.
